DB Goes 2-0 in Trials in 2013

Jeff Dermer - Friday, January 10, 2014

As 2013 came to a close, Dermer Behrendt scored a couple of major trial wins. In the first, DB, led by Kevin Behrendt, invalidated a California city's food truck ordinance on Constitutional grounds. DB has led the Constitutional fight against oppressive (and pointless) regulation of mobile vendors throughout California. Most choose to settle.

DB also prevailed in an interstate construction defect breach of contract arbitration tried in West Virginia. Jeff Dermer led that effort to hold an asphalt company fully liable for failed asphalt installation. The outcome was the result of proving that the contract had implied in law knowledge of site conditions and could not avoid responsibility based on estoppel and waiver theories against the general contractor.

Overall, 2013's litigation continued the firm's legacy excellent results in litigation and comfort in taking cases to trial and winning them.
